Dabei bestimmt er einen Start- bzw. Festpreis und eine Frist, binnen derer das Angebot angenommen werden kann (Angebotsdauer). Legt der Verkäufer beim Auktionsformat einen Mindestpreis fest, so steht das Angebot unter der aufschiebenden Bedingung, dass der Mindestpreis erreicht wird. 3. Der Verkäufer kann Angebote im Auktionsformat zusätzlich mit einer Sofort-Kaufen-Funktion versehen. Diese kann von einem Käufer ausgeübt werden, solange noch kein Gebot auf den Artikel abgegeben oder ein Mindestpreis noch nicht erreicht wurde. (...) 4. Bei Festpreisartikeln nimmt der Käufer das Angebot an, indem er den Button "Sofort-Kaufen" anklickt und anschließend bestätigt. Bei Festpreisartikeln, bei denen der Verkäufer die Option "sofortige Bezahlung" ausgewählt hat, nimmt der Käufer das Angebot an, indem er den Button "Sofort-Kaufen" anklickt und den unmittelbar nachfolgenden Zahlungsvorgang abschließt. Der Käufer kann Angebote für mehrere Artikel auch dadurch annehmen, dass er die Artikel in den Warenkorb (sofern verfügbar) legt und den unmittelbar nachfolgenden Zahlungsvorgang abschließt. 5. Bei Auktionen nimmt der Käufer das Angebot durch Abgabe eines Gebots an. Die Annahme erfolgt unter der aufschiebenden Bedingung, dass der Käufer nach Ablauf der Angebotsdauer Höchstbietender ist. Ein Gebot erlischt, wenn ein anderer Käufer während der Angebotsdauer ein höheres Gebot abgibt. (...) 6. Käufer können Gebote nur zurücknehmen, wenn dazu ein berechtigter Grund vorliegt. Nach einer berechtigten Gebotsrücknahme kommt zwischen dem Nutzer, der nach Ablauf der Auktion aufgrund der Gebotsrücknahme wieder Höchstbietender ist und dem Verkäufer kein Vertrag zustande. 8. In bestimmten Kategorien kann der Verkäufer sein Angebot mit einer Preisvorschlag-Funktion versehen. Die Preisvorschlag-Funktion ermöglicht es Käufern und Verkäufern, den Preis für einen Artikel auszuhandeln. (...) 11. Wird ein Artikel vor Ablauf der Angebotsdauer von eBay gelöscht, kommt kein wirksamer Vertrag zwischen Käufer und Verkäufer zustande." 2.2 Je nach Angebotsformat muss der Kunde für die Abgabe seines Angebots bei eBay folgende technische Schritte durchlaufen: 2.2.1 Auktionsverfahren Auf der Angebotsseite des Verkäufers gibt der Kunde zunächst den Betrag seines Maximalangebots in das dafür vorgesehene Eingabefeld ein und durchläuft dann die weiteren von eBay vorgegebenen Schritte. Abschließend klickt der Kunde auf den Button "Gebot bestätigen". 2.2.2 "Angebot an unterlegene Bieter"-Verfahren Der Kunde erhält zunächst per E-Mail eine Nachricht von eBay mit dem Betreff "Angebot an unterlegene Bieter". In der an ihn gesendeten Nachricht klickt der Kunde entweder auf den Button "Artikel aufrufen" oder auf den Button "Jetzt antworten" und durchläuft dann die weiteren von eBay vorgegebenen Schritte. Abschließend klickt der Kunde auf den Button "Kaufen". 2.2.3 "Sofort-Kaufen"-Verfahren / Warenkorbfunktion Auf der Angebotsseite des Verkäufers klickt der Kunde zunächst auf den Button "Sofort-Kaufen" oder - für den Fall, dass der Kunde mehrere Artikel im Rahmen eines Bestellvorgangs erwerben möchte - auf den Button "In den Warenkorb" und durchläuft dann die weiteren jeweils von eBay vorgegebenen Schritte. Dabei kann der Kunde wählen, ob er sich für die Bestellung in sein bereits vorhandenes eBay-Konto einloggt, ob er für die Bestellung ein neues eBay-Konto anlegt oder ob er die Bestellung ohne Anmeldung bei eBay als "Gast" ausführt. Abschließend klickt der Kunde auf den Button "Kaufen" bzw. - bei einer Bestellung als "Gast" und/oder bei einer Bestellung über die Warenkorbfunktion - auf den Button "Kaufen und zahlen". 2.2.4 "Preis-Vorschlagen"-Verfahren Auf der Angebotsseite des Verkäufers klickt der Kunde zunächst auf den Button "Preis vorschlagen" und durchläuft dann die weiteren von eBay vorgegebenen Schritte. Abschließend klickt der Kunde auf den Button "Preisvorschlag senden". Der Verkäufer kann den Preisvorschlag des Kunden sofort annehmen, sofort ablehnen oder überdenken, das heißt innerhalb der auf der Seite angezeigten Frist von maximal 48 Stunden annehmen, ablehnen oder durch einen Gegenvorschlag ablehnen. Lehnt der Verkäufer den Preisvorschlag ab, kann der Kunde einen neuen Preisvorschlag abgeben, indem er auf den Button "Neuen Preisvorschlag senden" klickt. Lehnt der Verkäufer den Preisvorschlag durch einen Gegenvorschlag ab, kann der Kunde den Gegenvorschlag binnen der auf der Seite angezeigten Frist von maximal 48 Stunden durch Klicken auf den Button "Preisvorschlag annehmen" annehmen, ablehnen oder durch einen Gegenvorschlag ablehnen, indem er auf "Gegenvorschlag senden" klickt. Im zuletzt genannten Fall sind die vorgenannten Schritte erneut zu durchlaufen 2.3 Der Vertragstext wird vom Verkäufer gespeichert und dem Kunden nach Vertragsschluss nebst den vorliegenden AGB und Kundeninformationen in Textform (z. B. E-Mail, Fax oder Brief) zugeschickt. Zusätzlich wird der Vertragstext bei eBay archiviert und kann vom Kunden unter Angabe der entsprechenden Artikelnummer für die Dauer von 90 Tagen nach Vertragsschluss unter www.ebay.de kostenlos abgerufen werden. Zur Anzeige der Artikelseite mit dem Vertragstext kann der Kunde die zugehörige Artikelnummer in das auf der eBay-Startseite vorhandene Suchfeld eingeben und auf den Button "Finden" klicken. 2.4 In allen oben genannten Verfahren kann der Kunde seine Eingaben wie folgt erkennen, überprüfen und korrigieren: Nach Anklicken des Eingabe-Buttons (z. B. "Bieten", "Sofort-Kaufen", "In den Warenkorb", "Preis vorschlagen", "Preisvorschlag überprüfen" oder "Neuen Preisvorschlag senden") kann der Kunde seine Eingaben auf den nachfolgenden Bestätigungsseiten nochmals überprüfen. Möchte er seine Eingaben korrigieren, kann er entweder durch Anklicken des "Zurück"-Buttons seines Browsers auf die eBay-Artikelseite zurückwechseln oder den Vorgang durch Schließen des Browserfensters abbrechen und die eBay-Artikelseite später erneut aufrufen. Die gewünschten Korrekturen können dann wieder mittels der üblichen Tastatur- und Mausfunktionen in den entsprechenden Eingabefeldern erfolgen. 2.5 Für den Vertragsschluss steht ausschließlich die deutsche Sprache zur Verfügung. 2.6 Die Bestellabwicklung und Kontaktaufnahme finden per E-Mail und automatisierter Bestellabwicklung statt. Der Kunde hat sicherzustellen, dass die von ihm zur Bestellabwicklung angegebene E-Mail-Adresse zutreffend ist, so dass unter dieser Adresse die vom Verkäufer versandten E-Mails empfangen werden können. Insbesondere hat der Kunde bei dem Einsatz von SPAM-Filtern sicherzustellen, dass alle vom Verkäufer oder von diesem mit der Bestellabwicklung beauftragten Dritten versandten E-Mails zugestellt werden können. 3.
